New Delhi: Noting that they are a flight risk, the Delhi HC has stayed a trial court order that allowed two Chinese nationals to visit their country.Both are facing prosecution in an alleged Rs 20,000 crore money laundering case linked with Vivo Mobile and were named by the ED in its chargesheet.The agency challenged the trial court’s June 17 order permitting the two accused to travel to China and sought an interim stay. Justice Tejas Karia, after hearing the submissions, also sought the stand of the two accused. HC will hear the matter next on July 2.HC noted that the accused are Chinese nationals facing allegations under Indian Penal Code and Prevention of Money Laundering Act. “Having regard to the nature of the allegations, the foreign nationality, and the absence of an extradition treaty or arrangement between India and the People’s Republic of China, the apprehension that he may not return to India cannot be said to be unfounded,” Justice Karia observed.Guangwen Kuang, an accused, had sought permission to travel abroad.
