NEW DELHI: The Delhi high court has temporarily restrained Bollywood actor Sanjay Dutt-backed CartelBros Pvt Ltd from using the term “Godfather” for its whisky brand, following a trademark dispute filed by Devans Modern Breweries, the name’s original claimant.HC noted that Devans has been producing beverages under the “Godfather” trademark for nearly four decades, and the name is strongly identifiable with the company in the alcoholic beverages market. CartelBros’ use of the mark could potentially benefit from the goodwill established by the old brand and dilute its distinct identity, HC observed. Noting that Devans is entitled to protection and an ad interim injunction is necessary, HC restrained the defendants from using “Godfather” or similar variations for their whisky products for their products during the ongoing proceedings. tnn
