Lucknow: The Lucknow bench of Allahabad high court has quashed an order passed by a magistrate court whereby it had rejected a woman’s plea, seeking production of income proof and property details of her husband in connection with a domestic violence case. The court has ordered the magistrate court to reconsider the woman’s plea afresh within six weeks . The court said that disclosure of actual income is important in cases related to maintenance and domestic violence and for this, the magistrate court can force the husband to give details of his income and property by issuing an order in this regard.A bench of Justice Brij Raj Singh passed the order on a petition filed on behalf of the woman and her minor son.The woman had filed an application before the additional chief judicial magistrate, first, Lucknow in the ongoing case under the Domestic Violence Act, accusing her husband and in-laws of dowry harassment, assault and financial torture and had said that under Section 91 of the BNSS, the husband should be ordered to submit his income tax returns and other financial documents. However, the ACJM, first, had rejected this application on Jan 19, 2026. The petitioners had challenged this order in the HC.The HC summoned the husband’s I-T returns of the past two years. According to the records, the husband is an architect and his annual income was around Rs 5 lakh, though he had described himself as a labourer in the court. HC said that as per the Supreme Court verdict in Rajnesh versus Neha, the husband can be required to provide necessary documents to accurately disclose his income and assets.
