Lucknow: The Lucknow Bench of the Allahabad high court has refused to entertain a plea in the Sahara Shahar dispute for lack of maintainability.The court said that the Sahara Shahar land issue is already pending in the Supreme Court, where Sahara has filed an application, and the municipal corporation has also filed an objection to it.The court said that since the Supreme Court is already hearing the case, the current petition is not maintainable at this stage.The bench of justices Rajan Roy and Manjive Shukla passed the order dismissing a petition filed by Sahara India Commercial Corporation Ltd. Expressing reluctance to hear the plea, the bench said, “We find our hands tied in proceeding any further in the matter.”The petitioner challenged an order of the Lucknow Municipal Corporation dated Sept 8, 2025, cancelling the land lease granted to Sahara on Oct 22, 1994, and a further order of Sept 11, 2025, ordering the land to be vacated.The petitioner said that an arbitration order was passed in its favour regarding the same land on Sept 2, 2017, but the LMC ignored the order and wrongly cancelled the lease, even though it was willing to deposit the money for extension of the lease. The LMC opposed the petition.During the hearing, the bench found that contempt petitions were pending in the Supreme Court against the Sahara Group regarding the order passed in the Sahara-SEBI dispute.Sahara filed an application before the Supreme Court on Sept 14, 2025, seeking permission to hand over several properties to the Adani Group so that the remaining compliance with the Supreme Court order could be completed by depositing the funds to be received in the Sahara SEBI account out of this transaction with the Adani Group.The bench also found that Sahara Shahar was among the properties listed by Sahara for handover to the Adani Group.
